Rental Agreement


Triskelion Arts requires a detailed description in writing of the planned use during your rental and your intended safety plan. Once your inquiry is approved, Triskelion Arts will require an in-person or virtual meeting to review our guidelines and protocols for using the space. Once these two steps are completed and payment has been processed, your rental will be considered confirmed and finalized.

CAPACITY & RATES
Renter understands and agrees:

  • that the capacity and crowd control for each booking will be in line with up-to-date state and city-wide guidelines and regulations and Triskelion Arts’ own capacity limits at the time of each rental; capacity is subject to change, and any changes will not result or a discount on the rental rate. Renter understands that Triskelion Arts will at all times limit the number of persons on the premises to the number permitted by local ordinances and requirements.   • that rates are non-negotiable.

USE OF SPACE
Renter understands and agrees:

  • to arrive and enter the building at the time of your rental to limit crossover and to avoid congregation in entryways.

  • to inform participants of which entrance to use when arriving.
    THEATER: enter up the ramp on Banker Street.
    DOUG & STU & LILLIAN: enter on Calyer Street.

  • to leave promptly and directly at the end of the rental period to avoid congregation in common areas.

  • to not congregate in the common areas outside of studios. 

  • that if the renter or any rehearsal participants begin to experience symptoms of COVID-19 during a rental, rehearsal must cease. Then, please exit the building, contact your healthcare provider and notify Triskelion Arts immediately.

REGULATIONS & COMPLIANCE
Renter understands and agrees:

  • to comply with the laws, orders, rules, and regulations of all federal, state, city, and local governmental authorities, as well as the local Board of Fire Underwriters or any other similar body, and the protocols and guidelines put forth by Triskelion Arts’ at all times and at the time of each booking.

  • to follow Triskelion Arts’ regulations and guidelines and up-to-date state and city-wide guidelines and regulations at each booking.

  • that regulations and guidelines are subject to change.

  • that changes to any and all COVID-related laws, orders, rules, and regulations of all federal, state, city, and local governmental authorities, as well as the local Board of Fire Underwriters or any other similar body and the protocols and guidelines put forth by Triskelion Arts’, will not result in a refund or discount to rental rate.

  • that COVID-19 capacity and crowd control for each booking will be in line with up-to-date state and city-wide guidelines and regulations and Triskelion Arts’ own capacity limits at each rental; capacity is subject to change, and any changes will not result or a discount on the rental rate. Renter understands that Triskelion Arts will limit the number of persons on the premises to the number permitted by local ordinances and requirements.   • mask requirements for each booking must follow Triskelion Arts’ regulations and guidelines and up-to-date state and city-wide guidelines and regulations at the time of each booking. Regulations and guidelines are subject to change and will not result in a discount or refund on the rental rate.

  • renter must alert Triskelion Arts if they or any of their participants test positive for COVID-19 14 days after the last visit to Triskelion Arts. If we are notified that the renter or any of their participants tested positive for COVID-19 within 14 days after their last visit, Triskelion Arts reserve the right to disclose to staff and relevant community members that an individual who tested positive or otherwise poses a risk to the community was in our facilities; names will not be disclosed unless legally required to do so.

  • Triskelion Arts reserves the right to oversee the renter’s activities in Triskelion Arts Facilities and must approve all uses in which the renter intends.

  • that despite all the precautions that the renter, and other participants and/or Triskelion Arts may take, Triskelion Arts cannot guarantee my health or safety, and I may still be exposed to COVID-19, including, without limitation, through touching and using the studios, common areas, bathrooms, and through direct and/or indirect interactions with other participants or staff who have COVID-19 or have been exposed to COVID-19. By accessing Triskelion Arts, I knowingly and voluntarily assume all risks and dangers, known and unknown, that are associated with any exposure to COVID-19, including, without limitation, suffering any type of medical condition, illness and, potentially, death.

USE OF SPACE

RENTAL ETIQUETTE, PLEASE…

  • no glitter, seriously, no glitter.  :)

  • no props, materials, or items that will scratch or harm the studio floors, walls, and other surfaces. Props, materials, and items used in the space must have soft bottoms, felt or rubber. Triskelion Arts reserves the right to approve all props, materials, and items that will be used in the space.

  • strike all trash and put in our trash receptacles and dumpster. it wasn’t meant to be; the sidewalk isn’t its home, take it with you.

  • do not prop open the exterior, studio, or bathroom doors.

  • no glass in the studios.

  • no aerial work of any kind.

  • do not touch the mirrors.

  • use indoor voices and sound levels out of respect for our neighbors and your fellow artists, especially when taking breaks in our outdoor areas.

  • no live music is allowed anywhere in the building unless previously approved by Triskelion Arts. If live music is approved, rates will vary.

  • no additional sound reinforcement beyond what is provided by Triskelion Arts, unless previously approved by Triskelion Arts. Triskelion Arts reserves the right to limit sound levels.

  • do not leave props or personal materials on the premises unless previously arranged with Triskelion Arts.

  • no painting or sewing, unless previously approved by Triskelion Arts.

  • no smoking, candles, incense, or open flames of any kind.

  • stay clear of the walls. They are not weight-bearing! :) 

  • Triskelion Arts is not responsible for lost or stolen articles, or for personal injury incurred on the premises.

  • no eating. Food is not allowed unless previously arranged with Triskelion Arts. If craft services are required, please provide this information with your initial inquiry or contact rentals@triskelionarts.org to update.

  • if anyone at any time should feel they may encounter a potentially unsafe situation, that person should immediately raise such concern to the renter and contact Triskelion Arts accordingly.

PAYMENT & CANCELATION

  • Payment is due to secure a booking and is non-refundable and non-transferable. Payment can be made via check or if paid by credit card, a processing fee is added. If your rental exceeds your scheduled and pre-paid timeframe, you will be required to pay for additional hours at 1.5 times the booking rate. Overtime hours are determined as a 15-minute hour.

  • A credit card is required to be securely stored for each booking in order to guarantee the booking, extra hours, and any damages caused by the Renter that may occur during the booking. By signing this form, Triskelion Arts is then given the authority to consider the securely stored credit card as a guarantee payment.

  • If a long-term outstanding balance occurs, any future booking will be denied until the balance is settled.

  • For some rentals, a refundable security deposit may be required at the discretion of Triskelion Arts.

USE OF TRISKELION ARTS’ FACILITY AND PHYSICAL PROPERTIES.

  • Renter agrees to provide Certificate of Liability Insurance and to add “TRISKELION ARTS-KICK-STANDANCE INC” as an additional insured to the policy.

  • Triskelion Arts agrees to provide use of its physical properties to the renter.

  • Renter agrees to restore the rented physical properties to good order within the booking timeframe, according to Triskelion Arts’ policies for the use of the facility. 

  • Renter is responsible for the strike of their items and equipment. All materials to be thrown away must be removed from the premises and legally discarded.  

  • Conduct of Activities: in connection with its use and occupancy of Triskelion Arts, Renter will not conduct its activities in such a manner as to constitute a nuisance or disturb any other occupants of the buildings in which Triskelion Arts is located or any other person on the premise and in the vicinity of Triskelion Arts’ physical location. Conversely, Triskelion Arts reserves the right to control the volume of any of the Renter’s activities.

  • Triskelion Arts reserves the right to oversee all the Renter’s activities during the rental and must approve all uses in which the renter intends to use Triskelion Arts’ facilities with such approval not to be unreasonably withheld. 

  • All Props/Set/Wardrobe/Additional Equipment must be approved by Triskelion Arts, with such approval not to be unreasonably withheld. All props, set, wardrobe, equipment must be adequately fire-proofed according to New York City law with a flame-proofing certificate provided by the renter before load into Triskelion Arts’ premises. Triskelion Arts' Technical Team must approve the hanging of any scenery, sets, props, or additional lighting or sound equipment and is subject to structural integrity, building technique, and feasibility of function within the space as determined by The Triskelion Arts’ Technical Team. 

  • Triskelion Arts reserves the right to approve and supervise any non Triskelion Arts personnel, technical collaborators, and representatives provided by the Renter and working under the direction of the Renter. The Renter’s additional personnel should contact Triskelion Arts no later than three weeks before the rental date for information exchange, house regulations, and consultation regarding the rental.

DUE CARE

  • Renter will be responsible for any damage to Triskelion Arts’s facilities caused by the renter or the actions of the renter’s representative(s), personnel, or collaborators. 

  • Renter shall at all times exercise due care in its use and occupancy of Triskelion Arts and its equipment. The renter shall not deface any physical parts of Triskelion Arts. Triskelion Arts retains the absolute right to terminate this agreement if the renter in any way abuses Triskelion Arts, endangers its team or equipment during the License Period.

  • No Other License Implied: The renter’s use and occupancy of Triskelion Arts will be restricted solely to the production’s intended activities previously agreed to in writing by Triskelion Arts and the renter. 

  • During the rental, the renter shall not use Triskelion Arts for any other purpose or permit any other person to use Triskelion Arts unless otherwise mutually agreed upon in writing. 

  • Indemnity: The renter shall indemnify and hold Triskelion Arts (together with its officers, directors, employees, and agents) harmless from any and all claims arising out of or relating to the rental, including without limitation, claims for loss, theft, damages, or injuries to property, and/or for any personal injury or loss of life occurring at Triskelion Arts and adjacent areas, except such claims as may be the result of Triskelion Arts' negligence. Renter shall indemnify and hold Triskelion Arts harmless from any lawsuits or judgments in any court of competent jurisdiction resulting from any such claims and any court costs and reasonable counsel fees that Triskelion Arts may incur in defense of any such claim or suit.

  • Calamity Clause: Renter agrees that Triskelion Arts will not be liable for failure to provide the physical properties and services to the renter as outlined in this agreement, in the event that such failure is caused by acts or regulations of public authorities, labor difficulties, civil tumult, strike, epidemic, fire, severe weather, or any other cause beyond the control of Triskelion Arts. 

  • Force Majeure: Triskelion Arts and the Renter agree that the other shall not be liable for any losses, damages, including consequential damages, delays, or failures to perform or provide said services agreed upon in this contract in whole or in part resulting from causes beyond the control of either party including, but not limited to fires, strikes, severe weather, pandemics, insurrections, riots, or requirements or regulations of any government or other civil or military authority, or any other cause beyond the control of Triskelion Arts or the renter.

  • COVID-19: Renter and Triskelion Arts are aware that the global COVID-19 pandemic is occurring worldwide. Should the pandemic occur during the term of this Agreement, the parties agree that the Force Majeure provisions shall be triggered, as set forth above. Additionally, the parties agree that they have amended their Policies and Procedures and any agreements with subcontractors or independent contractors to take into account such an event.  

  • Renter agrees that its personnel, representatives, performers, collaborators shall read and observe at all times the rules and regulations pertaining to the use of Triskelion Arts and its equipment outlined in this agreement or contained in any other materials that may subsequently be given to the renter. The Renter is solely responsible for any loss, damages, and/or injuries resulting from its or its participant’/collaborator’s failure to observe those regulations.

  • Renter agrees to provide Certificate of Liability Insurance and to add TRISKELION ARTS-KICK-STANDANCE INC as an additional insured to the policy.

Triskelion Arts will remain compliant with all city and state-wide mandated COVID-19 SAFETY protocols and guidelines.

Triskelion Arts is a sanctuary space. Triskelion Arts agrees to provide and maintain a safe space and an inclusive home free of mistreatment, judgment, and dismissal; to honor our space and the beings and objects within it; to operate with compassion, love, and consideration; to continually cultivate an environment where care and trust inform our actions; to respect each person's humanity; to work in collective collaboration with our community to find solutions and evolutions; not to tolerate violent or abusive speech or actions; to constantly evaluate ourselves and hold ourselves accountable.
